These Terms of Service ("Terms") govern your use of lumiereparis.shop (the "Site") and the purchase of products from Lumière Paris ("we," "us," "our"). By accessing the Site or placing an order, you agree to be bound by these Terms in full.
If you do not agree with any part of these Terms, please do not use the Site or purchase from us.
1. Eligibility
By placing an order, you confirm that:
- You are at least 18 years old or have parental/guardian consent
- The information you provide is accurate, current, and complete
- You are purchasing for personal use, not for resale
We reserve the right to refuse or cancel any order at our sole discretion.
2. Products & Pricing
Product descriptions: We make every effort to describe our products accurately. Colors, finishes, and details may vary slightly from images shown due to screen settings, photography lighting, and manufacturing batches.
Pricing: All prices are displayed in the customer's local currency where available, otherwise in the store's base currency. Prices are subject to change without notice. The price charged is the price displayed at the time of order placement.
Pricing errors: In the event of a pricing error, we reserve the right to cancel any affected order even after order confirmation. You will be notified and any payment refunded in full.
Promotional discounts: Promotional codes, sale prices, and bundle offers are subject to availability and cannot be combined unless explicitly stated. We reserve the right to end or modify any promotion at any time.
3. Orders & Payment
By placing an order you authorize us to charge your chosen payment method for the full order amount, including any applicable taxes and shipping fees.
Order acceptance: An order is only accepted once payment has cleared and you receive an order confirmation email. We reserve the right to cancel any order for reasons including (but not limited to): suspected fraud, payment failure, stock unavailability, suspected resale activity, or shipping to restricted regions.
Payment methods: We accept major credit/debit cards, PayPal, Apple Pay, Google Pay, and Shop Pay. All transactions are processed through secure third-party payment processors.
4. Shipping & Delivery
Processing time: Orders are processed within 1-3 business days after payment confirmation.
Delivery time: Standard shipping typically takes 6-10 business days depending on destination. Delivery times are estimates only and not guaranteed.
Shipping costs: Calculated at checkout based on destination.
International orders: May be subject to customs duties, taxes, or import fees charged by your country's customs authority. These are the customer's responsibility and are not included in the order price or shipping fee.
Delivery confirmation: Once a package is marked "delivered" by the carrier, ownership and risk transfer to the customer. We are not responsible for packages lost or stolen after delivery confirmation.
Incorrect shipping information: If you provide an incorrect or incomplete shipping address, you may be charged for re-shipment. If the package is returned to us as undeliverable, you may be refunded for the product but not the shipping cost.
5. Returns & Refunds
All returns are governed by our Return & Refund Policy, available here. Key points:
- Returns must be initiated within 14 days of delivery
- Items must be unused, in original packaging, with all accessories
- Customer is responsible for return shipping costs
- Returns sent without prior authorization will not be processed
- Original shipping fees are non-refundable
- A restocking fee of up to 15% may apply if items are returned not in original condition
- Digital products (eBooks, downloads) are non-refundable once accessed
- Items damaged through misuse, neglect, or unauthorized modification are not eligible for refund
Nothing in this section limits your statutory consumer rights under applicable law.
6. Product Use & Disclaimers
Intended use: The Lumieyes® device is intended for cosmetic use only. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any medical condition.
Consult your doctor: Before use, consult a qualified healthcare professional if you:
- Are pregnant or breastfeeding
- Have a pacemaker or implanted medical device
- Have epilepsy or a history of seizures
- Have an active eye condition, infection, or recent eye surgery
- Have any skin condition affecting the under-eye area
- Are taking medications that increase photosensitivity
Results: Individual results vary. Testimonials, before/after photos, and statistics shown on our Site represent individual experiences and are not guarantees of specific results for any user. Consistent use as directed is required for visible improvements.
Safe use: Follow all instructions provided with the device. We are not liable for any injury, damage, or adverse effect resulting from misuse, overuse, or use contrary to the included instructions.
7. Intellectual Property
All content on this Site — including text, graphics, logos, images, videos, the Lumière Paris name, the Lumieyes name and logo, product designs, and the Undereye Revival Guide — is owned by Lumière Paris or licensed to us and protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, publish, or use any content for commercial purposes without our express written permission.
8. User Conduct
You agree not to:
- Use the Site for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Site or our systems
- Reverse-engineer, copy, or resell our products
- Submit false information when placing orders
- Use the Site to harass, abuse, defame, or harm others
- Engage in fraudulent payment activity or chargeback abuse
Chargeback abuse: Filing a fraudulent chargeback (disputing a charge you authorized) is considered fraud. We will provide all evidence of delivery, order confirmation, and use to your bank or card issuer. Customers found to have filed fraudulent chargebacks may be permanently banned from purchasing from us and reported to fraud prevention databases.
9. Limitation of Liability
To the maximum extent permitted by law:
- Lumière Paris is not liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our products or Site
- Our total liability for any claim shall not exceed the purchase price of the product giving rise to the claim
- We make no warranties beyond those expressly stated in writing
- All implied warranties (including merchantability and fitness for a particular purpose) are disclaimed to the extent permitted by law
Nothing in this section limits liability for death, personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.
10. Indemnification
You agree to indemnify and hold harmless Lumière Paris, its directors, employees, and agents from any claims, losses, damages, or expenses arising from your breach of these Terms or misuse of our products.
11. Modifications to Terms
We reserve the right to update or modify these Terms at any time without prior notice. Continued use of the Site or placement of new orders after changes constitutes acceptance of the updated Terms.
It is your responsibility to review these Terms periodically. The "Last Updated" date at the top reflects the most recent revision.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of United Kingdom, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the courts of United Kingdom.
13. Severability
If any provision of these Terms is found to be unlawful or unenforceable, that provision shall be deemed severable from the remaining Terms, which shall remain in full force and effect.
